In beginning his sentencing this morning, Judge Keelan Johnston described witness accounts of the accused's car driving erratically and swerving into oncoming traffic, resulting in several near misses.

Sentencing will take place in January.

Judge Connolly stated that while the court "could be somewhat human at times", all options would be examined should Mr Reilly not complete the payments.

The court heard that the digger was driven a short distance at around 2mph before being discovered at the rear of a property a few days later.

The comments were made at Longford Circuit Court this week.

The trial is taking place at Longford Circuit Criminal Court.

Judge Keenan Johnson dismissed arguments from the defendants and gave them a 2-week deadline.

According to the Judge, the three men must have the balance of the fines paid when the case comes in front of him again in October.
