Reprieve for local landowners as new right of way laws delayed

The Minister for Justice secured Cabinet approval to amend the provisions in the Land and Conveyancing Law Reform Act 2009 in relation to rights of way.

Landowners in the Shannonside region concerned about possible loss of rights of way have been given a reprieve this week after the Government confirmed a plan to delay the implementation of new laws

Legislation passed in 2009 required that means of access must be registered with the Circuit Court or Property Registration Authority.

However, the deadline date of November 30th has now been delayed by the Justice Minister Heather Humphries following confusion and concerns from landowners over access to water supply, the buying and selling of property and mortgage approval.

In May of this year, The Law Society sought a six-year extension of the 2009 Act in an effort to halt registrations and also requested that the area of easements be referred to the Law Reform Commission for a full review.

Speaking to Shannonside Northern Sound, Paddy Sweetman from The Law Society said it is hoped that if you enjoyed a right of way in the past, you will enjoy it in the present.
